Former teacher sentenced in case of child molestation

Friday morning marked the end of a three-year scandal surrounding a former Basehor Elementary fifth-grade teacher accused of inappropriately touching his students.

Leavenworth County District Judge Gunnar A. Sundby gave Floyd M. Rogers Jr. a suspended sentence of 32 months in prison for each of three counts of attempted aggravated indecent liberties with a child.

After suspending the prison term, though, Sundby ordered Rogers, of Bonner Springs, to spend 30 days in jail — 10 days for each count — to be served on weekends, starting the weekend of Jan. 9.

Rogers also was ordered to undergo 36 months of intensive supervised probation with Leavenworth County Community Corrections.

Leavenworth County Attorney Frank Kohl said Rogers would be fervently monitored to ensure he was adhering to all conditions of his probation.

If Rogers does not comply with the terms of his probation, Kohl said, he is required to serve the full eight years in prison.

“He’s going to be watched closely,” Kohl said. “If he violates anything during that three-year probation, he will go to prison.”

Rogers was charged with three counts of aggravated indecent liberties with a child in December 2005. He resigned from his upon notice of the charges and after being placed on administrative leave.

Rogers entered a plea of no contest in December of last year.

The charges were later amended to three counts of attempted aggravated indecent liberties as part of the plea agreement and because it was alleged that Rogers touched the three students on the outside of their clothing.

Kohl said that Rogers’ teaching license had been revoked, and he would have to register as a sex offender.

“He will also have to complete a sex offender evaluation in terms with his probation,” Kohl said.

Kohl said that Rogers would be required to enter a treatment plan deemed appropriate by the results of his evaluation.
