Tonganoxie man pleads guilty to fracturing infant son’s skull

A 30-year-old Tonganoxie man admitted to fracturing his 3-month-old son’s skull Monday while in Leavenworth County District Court.

Derek Foote entered a guilty plea to aggravated battery of his three-month-old son after it was discovered the baby sustained a skull fracture while left in Foote’s care. The state presented evidence at preliminary hearings Sept. 17, 2015, and again Sept. 30, 2015. On Sept. 30, a doctor from Children’s Mercy specializing in child abuse pediatrics testified that having reviewed the injuries and the other information provided, he diagnosed the baby as having suffered from child physical abuse, according to Leavenworth County Attorney Todd Thompson.

Foote also entered a guilty plea to marijuana possession stemming from contact with law enforcement on Nov. 22, 2014.

Foote is scheduled to be sentenced on March 11.
