Woman who attempted escape from Leavenworth County Justice Center sentenced to prison

A Lansing woman has been sentenced for attempting to escape from custody and unlawfully possessing drugs.

A Leavenworth County Judge sentenced Sarah Cape, 33, on July 14 to serve 50 months in the Kansas Department of Corrections.

Cape was arrested on March 29, 2022, after deputies located her inside a hotel room. Inside that hotel room, Cape was found to have numerous drugs in her possession – including methamphetamine, fentanyl, and heroin. Cape also identified a metal spoon that she cooks heroin in and a marijuana pipe, according to a release from the office of Leavenworth County Attorney Todd Thompson.

Cape was arrested on April 26, 2022, and later charged with attempting to escape from custody. Cape, who was in custody on a bond violation, was in the process of being taken by jail staff from the visitation area of the Justice Center to one of the jail entries when she ran. A member of the jail staff gave chase and fell in the process. During the fall, that officer hit her hand on a trashcan. Cape was apprehended before leaving the Justice Center.

On April 26, a year after attempting to escape custody, Cape entered a plea of “no contest” on the charge of attempted aggravated escape from custody. Cape also entered pleas of “no contest” on three charges of possession of a controlled substance and on a single count of possession of drug paraphernalia used to introduce a controlled substance into a human body. The drug-related convictions stem from the March 29, 2022, arrest at a hotel in Leavenworth County.

“We’re doing everything we can to get drugs, particularly fentanyl, off our streets.” Thompson said. “We always hope we can help people fight their addictions, but they have to want to do it as well, and running from law enforcement is not a way of showing it.”

In case 2022-CR-000140, Cape received 40 months in prison for unlawfully possessing methamphetamine, 11 months for unlawfully possessing fentanyl, 11 months for unlawfully possessing heroin, and six months in jail for possessing drug paraphernalia. The court ran all four counts concurrent to 40 months. In case 2022-CR-000485, Cape was sentenced to 10 months in prison for attempted aggravated escape from custody. Sentences will run concurrently in case 2022-CR-000140, while sentencing in case 2022-CR-000485 will run consecutively to 2022-CR-000140 for 50 months in the Kansas Department of Corrections.
