Scott Robert Bollig of WaKeeney was charged Tuesday with first-degree murder, The Salina Journal reported.

The criminal complaint filed in Trego County by Attorney General Derek Schmidt accuses Bollig of putting the crushed medication on a pancake for the pregnant woman to eat. The incident allegedly occurred Jan. 26.

The complaint, which doesn’t name the medication or say when the fetus died, also includes an alternative charge of attempted murder, as well as one count each of aggravated battery and distribution of adulterated food. The woman also suffered “great bodily harm,” according to the complaint.

Schmidt’s spokesman, Clint Blaes, said he could not provide any details about the case beyond what was in the complaint.

Bollig’s lawyer, Daniel Walter, said Wednesday he also could not discuss specifics about the case. But Walter said he intends to challenge the law used to charge Bollig. The statute, known as Alexa’s Law, gives prosecutors the authority to charge someone with murder, manslaughter or battery for intentionally harming a fetus.

Under the law, when a pregnant woman is attacked, prosecutors can charge the alleged assailant with a crime against the woman and a separate crime against the baby she’s carrying. The law excludes abortion.

Bollig’s bond was set at $500,000.
